On Sept. 18, the Pretrial Fairness Act will take full effect in Illinois, eliminating the use of money bond and redesigning pretrial processes to increase transparency in release and detention decisions. Cook County stands ready to implement all aspects of the Act, including the new initial appearance and detention hearing processes.
Block Club Chicago reporter Maxwell Evans wrote about our work to take take traditional criminal legal defense out of the courthouse and into the community to provide more collaborative representation and services. JB Pritzker signed SB424 and SB1886 into law, expanding rights and opportunities for people accused of gun possession and people on probation, respectively. Mitigation Specialists play a key role in public defense, advocating for a fair sentence by putting together a thorough report on the person’s life story. This is important because when a person comes before a judge for sentencing, the court is often aware of only a sliver of their circumstances.
We in the Juvenile Justice Division of the Cook County public defender’s office share in the outrage that led to the Cook County public guardian suing DCFS for allegedly failing to find appropriate placement for these children. In any given month, there are children in detention who have been ordered released — children who are among the most vulnerable members of our society.

Instead, another young Black person’s family is coping with the reality that the individuals entrusted to serve and protect us all took their loved one’s life in a savage fashion.

The Illinois Supreme Court today issued an order suspending implementation of the Pretrial Fairness Act while it reviews a lower court opinion that found the law unconstitutional.
The Cook County Public Defender’s Office is disappointed that this historic and transformative law will not take effect as planned tomorrow, Jan. 1.
